PUNJAB STATE DELUX MONTHLY LOTTERY SCHEME

Notification No.21/2(1)/2017-18/LEII                                                  Dated, Chd the_______2018

The Governor of Punjab, in exercise of the powers conferred upon him under section 4 of “The Lotteries (Regulations) Act 1998” read with rule 3 of “The Lotteries (Regulations) Rules 2010” and all other powers enabling him in this behalf , is pleased to promulgate the following scheme to conduct a Bumper lottery scheme in the State viz:

1. THE NAME OF THE SCHEME AND THE LOTTERY
The Scheme shall be called the “Punjab State Delux Monthly Lottery Scheme” and a lottery marketed in the State of Punjab under this scheme shall be called the “Punjab State Delux Monthly Lottery Scheme".

2. NUMBER OF TICKETS
The scheme shall have Two Lakh lottery tickets without series numbering from 000000 to 199999 each. These Number of tickets can be increased or decreased as per demand of Distributors and keeping in view the market conditions.

3. TICKET PRICE
The MRP of a single ticket shall be Rs 100/-.( Rupees Hundred only).The value of the ticket on which tickets should be issued to Distributors will be Rs. 89.30 (Rupees eighty nine and thirty paisa only). The Gross value of the total number of tickets in scheme shall be Rs. 1, 78,60,000/- ( Rs. One crore seventy eight lakh sixty thousand only).

4. PRIZE STRUCTURE OF THE SCHEME

The detail of Prizes for Winners and Promoter Prizes for Agents, Sub-agents and Sellers shall be as under:-

5. METHOD OF DRAW

The following prizes shall be given on the basis of the draw, to be conducted by Director Lotteries or officers deputed by him in this behalf in accordance with the method prescribed against each prize.

1st Prize

Rs.Twenty Lakh Only

One complete number of six digits will be drawn. If number fall from un-sold ticket, the machine will be re-operated till the prize is drawn from sold tickets.

2nd

One complete number of six digits will be drawn. If number fall from un-sold ticket, the machine will be re-operated till the prize is drawn from sold tickets.

6. DATE TIME AND VENUE OF THE DRAW

The draw will be held on every last Friday of each month at Ludhiana. In exceptional circumstance with the prior approval of the Government the said date of draw and venue can be changed. The Director Lotteries will decide the time and venue of the draw.

7. COMMISSION /INCENTIVES TO BE PAID IN SALE OF TICKETS

(a) Commission of Rs. 18/- (Rupees eighteen only) per ticket will be given to the agent on the ticket sold. Any commission due shall be paid to the distributor(s) or selling agents out of the money so deposited in the Public Ledger Account or in the Consolidated Fund of the State after depositing 100% payment of the sale proceeds through Bank draft. TDS etc. will be deducted at source while making payment of commission etc.

(b) That the agent/distributors shall conduct the business in accordance with the law/ rules and regulations as may be in force in various State/Union Territories of India and shall pay taxes, levies, octroi etc, as may be applicable from time to time. Presently the Central Govt. has introduced GST on lotteries and the same will be paid by the Distributor as per Notifications issued by Govt. Of India. Further any other tax on Lotteries imposed by the Central Government/ State Government from time to time will be borne by the distributor/selling agent or as decided by the Government. Any commission due shall be paid to the distributor(s) or selling agent(s) out of the money so deposited in the Public Ledger Account or in the Consolidated Fund of the State after 100% payment of the sale proceeds is deposited by them through Bank draft or Cyber treasury. TDS etc. will be deducted at source while making payment of commission etc.

(c) There will be no promoter coupon. Tickets should be stitched in the bundle of fifty tickets.

8. PROCEDURE FOR ISSUE OF TICKETS AND DEPOSIT OF SALE PROCEEDS.

i) Any Distributor(s)/Selling Agent(s) for this Lottery scheme will be appointed subject to the condition that they will have to ensure sale of at least 1,50,000 (One Lakh fifty thousand only) tickets in first instance, in case there is a single Distributor/ Agent, if there are two agents the limit of minimum tickets for each Distributor/agent will be 75,000 (Seventy five thousand) tickets in first instance and in case there are more than two distributors/agents the minimum limit of lifting the ticket will be 50,000 (Fifty thousand) tickets in first instance for each distributor/agent.

This department may also appoint more Distributors/ Agents, who will be required to sell tickets in the first instance as decided by the Director. Agreement will be executed by the department with the Distributor/Selling Agent and the department will obtain an agreement signing fee of Rs. 2 lakh (Rupees two lakh) from the distributor/agent in the shape of D.D. in favour of Director, Punjab State Lotteries payable at Chandigarh, which will be adjusted at the time of lifting of tickets by them and in case the distributor/agent fails to lift tickets, this amount of Rs. 2 lac will be forfeited.

However, considering the market situation and in the best interest of the state and to increase the sale of tickets, the Director Lotteries may, if deemed appropriate, may increase or decrease this minimum limit of tickets. In order to promote the sale of tickets and in Public Interest, the Department can work out distribution and sale of tickets directly or through District Small Saving Officer, District Small Saving agents or Post Offices in Punjab or any other Department, Semi Government entity, Corporation or Board etc., by offering different rate of commission /promoter coupons and specifying different minimum limits (if any) for lifting of tickets and other suitable terms, to be decided by the Director Lotteries. The delivery of tickets will be given at Ludhiana. The expenditure on sending tickets by post/courier service if demanded by anyone will have to be borne by the concerned distributor/agent.

In order to make Punjab State Lotteries more popular in other States, the department will explore the possibility of sale of tickets in other States as per the law. Minimum number of tickets to be sold in other States will be decided by Director Punjab State Lotteries and further the Director Lotteries, at his own level will do the appointment of Distributor/Agent for sale the tickets in other States.

ii) The Distributor/Selling Agents shall get delivery of tickets by making payment of 100% of the face value in cash/Bank Drafts:-

The distributor/selling agents shall get delivery of tickets on following payment terms: -

(a) Payment of at least 25% of the face value as Cash /Bank Drafts; and

(b) 75% by furnishing security in the shape of Bank Guarantee / FDR etc. mortgaged/ pledged in favor of the Director, Punjab State Lotteries, Chandigarh. Validity of the bank Guarantee / FDRs should remain valid for sufficient period.

However the balance payment of 75% of face value of tickets sold subject to minimum specified limit as on the date of draw, if any, has to be paid on or before the date of draw, itself through Demand Draft failing which the agent shall be charged interest @18% p.a, for the delayed period. Interest will be charged on month to month basis.

(iii) The tickets will not be issued to the Distributor/Selling Agents if they fail to settle the accounts of any previous lottery scheme within stipulated period.

(iv) The request for sending the ticket by post as received in office will not be entertained and the tickets will not be dispatched to the individual customer from office.

(v) The tickets shall be issued to the selling agents/distributor as per the procedure laid down in condition 8(ii) above. However full and final payment as per the face value of the tickets so sold shall be paid on or before the date of draw itself through Demand Draft failing which the distributor/agent shall be charged interest @18% p.a, for the delayed period. Interest will be charged on month to month basis.

10. UNSOLD TICKETS

The distributor/selling agent will submit the list of unsold tickets, in shape of hard copy and soft copy, subject to the minimum tickets prescribed [in para 8(i)] here to be lifted in the first instance, in the office of Director Lotteries up to 12.00 noon on the date of draw and no list of unsold tickets would be entertained by the office after scheduled time. The signed list of unsold tickets can be sent through registered post or through special messenger or email but this Department will not be responsible for any postal delay.

11. PAYMENT OF PRIZES/ INCENTIVES TO PRIZE WINNERS/DISTRIBUTOR/AGENTS

(i) All the prize winning tickets above Rs. 5,000/- should reach the office of the Director, Punjab State Lotteries, Vit Te Yojna Bhawan , Plot No. 2-B , Sector 33 A, Chandigarh-160020 on the prescribed form within 30 days from the date of publication of the result in the Punjab State Government gazette either personally or through a nationalized bank or by registered post or by insured parcel.

(ii) Sellers’ and Sub- Agents’ promoter incentive up to Rs. 1,000/- should be claimed from the Distributor(s)/Selling Agent(s) within 30 days from the date of publication of the result in the Punjab State Government Gazette and the promoters prizes above Rs. 1,000/- should be claimed directly from the Director, Punjab State Lotteries Vit Te Yojna Bhawan, Plot No. 2-B , Sector 33 A, Chandigarh-160020 within 30 days from the date of publication of the result in the Punjab State Government gazette. The Distributor/ Agent(s) promoter incentive may be claimed from the Director Punjab State Lotteries directly. TDS will be deducted at source while making payment of such incentive(s).

(iii) In case the prize winners claim does not reach this Directorate within 30 days, the right of the winner to claim the prize/amount thereafter shall be extinguished in accordance with the Punjab State Lotteries Rules 2015. The Director or the State Government, as the case may be, may in exceptional circumstances and on sufficient cause being shown, condone the delay in submission of claim after the prescribed 30 days in accordance with the rules ibid. Distributor/Agents are authorized to make the payment of prizes/incentives below above said limit and seek reimbursement from office within 90 days from the date of publication of the result in the Punjab State Government gazette.

12. Permission to sell Punjab Lottery through computer terminals/Internet as Additional Marketing Strategy

The Government at its sole discretion may allow the Distributor/Selling Agent to sell part or all lottery tickets through web site/ internet mode as as additional market strategy. The permission in this regard will be allowed on the following conditions:-

1) Sale of tickets through Internet will be governed strictly for the particular lottery.

2) The tickets for a particular lottery scheme (s) sold through both conventional retail outlets and Internet outlets will not exceed the total number of tickets of that particular lottery scheme(s).

3) The total number of lottery tickets with numbers fed in the Server Machine for selling through Internet and number of sold and number of tickets in hand with respective tickets numbers shall be notified through Internet before commencement of draw of a particular scheme and a written statement thereof shall also be submitted to this Department.

4) The programming shall be so configured to ensure that as soon as a particular ticket number is sold, the number of the ticket shall be eliminated from the list of the tickets available for sale.

5) The Internet system being used will be subjected to a system audit at the distributor level by any audit agency. The Distributor/Selling Agent will have to bear the expenditure on the system audit.

6) The Central Computer Server which accepts, processes, stores and validate each transaction must be under the control of the Director, Punjab State Lotteries.

7) The Management Information System shall provide detailed information regarding the complete scheme and each and every transaction on the following to the Director, Punjab State Lotteries from time to time through Dealer Control Panel/Replica of system.

a.1. Passwords Master Passwords / Sub Password,

a.2. Agent Identity Code No.

a.3. Sub Agent Registration.

a.4. Sub Agent List.

a.5. Sub Agent wise daily sales.

a.6 Scheme/Stock availability

8) The Distributor/Selling Agent will ensure that the application software interface have some minimum common features and functionalities to ensure a high level of reliability, security, redundancy, scalability and manageability. The Distributor will provide the entire feature related with the sale, encashment etc. of tickets as in the master server.

9) The Central Computer System installed by the Distributor/Selling Agent will be under the control of the Government i.e office of Director, Punjab State Lotteries. The operation be done under the strict control and supervision of the Directorate of Punjab State Lotteries, The Central Computer System shall be equipped with all the desired information by maintaining redundancy at the office of Director.

10) The Distributor/Selling Agent will have to use pre printed and pre numbered stationary for printing of cash receipts at the retail outlets. The same will be provided by the Government however the cost of this will be recovered from the concerned agent.

11) No information regarding Punjab Lotteries other than the lottery results duly signed by the officer(s) of the Lottery Department and advertisements duly approved by the Director, Punjab State lotteries shall be fed/ passed through INTERNET channel.

12) No separate draws shall be conducted for those lotteries sold partly or fully through INTERNET.

13) All expenditure on creation of Central Computer System Infrastructure, assets, expenditure on men power, management, connection charges, other charges etc. shall be borne by Distributor.

14) The Distributor will ensure the compliance of all rules, laws, regulations and orders etc. and in the event of any violation of any, the responsibility will rest on the Distributor and Distributor/Selling Agent will be liable to compensate the Government in case of any loss / damages suffered by the Government.

15) The permission to sell lottery tickets is subject to the territorial jurisdiction of Punjab except the permission granted for lottery operating State by the Government. The Distributor has to submit an undertaking that they are not marketing any ticket through Internet outside the territorial jurisdiction of Punjab and the territorial jurisdiction of Punjab will not be violated in any event.

16) In case there is violation of any of the terms and conditions mentioned above, the permission so granted shall be taken back by the Government without any notice or compensation of any kind.

17) In case of any loss to the Government due to sale of tickets though Internet the permission shall be withdrawn.

18) The permission being given is provisional and can be withdrawn at any time by the Government without assigning any reason and the Distributor/Selling Agent will not be entitled to any damages/ loss on creation of infrastructure etc. The use of such discretion by the Government shall be binding on the Distributor/Selling Agent.

19) The Distributor/Selling Agent shall ensure that receipts/ cash memo as proof of purchase of tickets being generated at the terminals bear the logo of the Punjab Government.

20) As per the scheme sanctioned for each draw, the number of tickets to be sold through Internet for each draw shall be intimated to the Director at least one week in advance.

21) In the event of any loss accrued to the Government due to the actions on the part of the Distributor/Selling Agent or dispute between the Distributor and its sub-Agents /Retailers or any other person in regard to the sale of tickets or any other reason, the Governments shall be at liberty to withdraw this permission, the decision of the Government in this regard will be final and binding on the Distributor/Selling Agent.

22) In case there is violation of any of the terms and condition mentioned above, the Government will have the absolute right to withdraw this permission and the Distributor/Selling Agent shall not be entitled for any compensation of any kind.

23) The compliance of above mentioned conditions is a pre condition for the sale of tickets of Punjab State Lotteries on terminals through Internet/Website.

13. LEGAL JURISDICTION

The legal jurisdiction of this lottery shall be only at Chandigarh.

14. OTHER IMPORTANT CONDITIONS OF THE SCHEME

The draw for the prizes will be held out of the total scheme. However, the draw of first, second and third prize (s) will be out of sold tickets only.

ii) Income Tax on prizes / incentive(s) to sellers etc., wherever applicable, shall be deducted at source irrespective of the fact whether the prize goes to the winners, distributor(s)/selling agent(s) or seller(s).

iii) Promotional publicity will be got done through the Directorate Public Relation Department Punjab , Chandigarh on the DAVP/DPR rates through the mode of T.V., Radio, newspapers, banners, hoardings etc. Therefore, a provision of Rs 10.00 lacs (Rupees Ten lacs only) is made for advertising through T.V, Radio, Newspapers and hoardings etc. and Rs. 10.00 lacs (Rupees Ten lacs only) for printing of tickets, coupons etc. Distributors/Agents may be allowed to make publicity through banners and cassettes, the rates/criteria of which will be approved by the Designated Authority.

iv) GST imposed by the Government of India on Lotteries will be borne by the Distributor/ Selling Agent.

v)Distributor(s)/Selling Agent(s)/ Sub Agents and sellers are advised to check the correctness of the printing and numbering of the tickets before selling and buyers should also check the same before purchasing tickets. Defective tickets should not be sold to the public, but should immediately be returned to the issuing authority

vi) A ticket, which is forged, torn out, mutilated or tampered with shall not be entertained.

vii) Prize will be paid on the production of original tickets only.

viii) Prize winning tickets holders abroad will be paid in Indian currency as per scheme.

ix) One ticket will be eligible to only one incentive viz. The highest incentive drawn against it.

x) In case of any dispute, the decision of the Principal Secretary to the Government of Punjab, department of Finance shall be final and binding.

xi) Before submitting the claim, results may be checked with the Punjab State Government Gazette.

xii) The request for sending the tickets by post as received in the office will not be entertained and the tickets will not be dispatched to the individual customers from office.

xiii) The provisions of ‘The Lotteries (Regulation) Act 1998‘and ‘The Lotteries (Regulations) Rules, 2010 and Punjab State Lotteries Rules 2015 shall be applicable.

15. AMENDMENTS TO THE SCHEME

The Government of Punjab may at any time amended/ delete/ modify/ relax any of the provisions of the Scheme under the orders of the Principal Secretary Finance; Government of Punjab in exceptional circumstances without assigning any reasons(s).

Notes:   i) The Director, Punjab State Lotteries will get the tickets / promoter coupons / posters will be got done from the Security Printing Press on the panel of Reserve Bank of India or the Indian bank Associations Mumbai, However, posters will be got printed from the private printing press which stands selected through open tenders at approved rates or as decided by the Govt. keeping in view the prevailing circumstances.

ii) The expenditure for making payment to Prize winners/Selling Agents/Distributors / Sellers/ Advertisers/ GSM checking Institutions/ Laboratories/ Printers, Taxes on whereas, Draw Exp. etc. under this scheme shall be met from the Budget grant provided in the budget by the State Government. The Director, Punjab State Lotteries is authorized to sanction makes all kinds of payments mentioned above. Incentive to officers / officials will be paid as per policy decision to be taken in this regard on a separate file.
