The Governor of Punjab, in exercise of the powers conferred upon him under section 4 of “The Lotteries (Regulations) Act 1998” read with rule 3 of “The Lotteries (Regulations) Rules 2010” and all other powers enabling him in this behalf , is pleased to promulgate the following scheme to conduct a Bumper lottery scheme in the State viz:

1. THE NAME OF THE SCHEME AND THE LOTTERY The Scheme shall be called the “Punjab State Diwali Bumper 2018” and a lottery marketed in the State of Punjab under this scheme shall be called the “Punjab State Diwali Bumper 2018".

2 NUMBER OF TICKETS The scheme shall have Twenty Lakh lottery tickets with series A and B, series numbering from 000000 to 999999 each.

3. TICKET PRICE The MRP of a single ticket shall be Rs 200/-.( Rupees Two hundred only). The value of ticket on which tickets should be issued to the Distributors will be Rs.178.57 per ticket i.e the said price will be the face value of ticket. The Gross value of the total number of tickets in scheme shall be 35, 71, 40,000/- (Rupees thirty five crore seventy one lakh forty thousand only)

5. METHOD OF DRAW

The following prizes shall be given on the basis of the draw, to be conducted by Director Lotteries or officers deputed by him in this behalf in accordance with the method prescribed against each prize.

1st Prize

Rs.One Crore fifty lakhs each


Two complete numbers will be drawn along with series. One from series A and another from series B. If numbers fall from un-sold ticket, the machine will be re-operated till the prize is drawn from sold tickets.

Five complete numbers will be drawn along with series. If numbers fall from un-sold ticket, the machine will be re-operated till the prize is drawn from sold tickets.

6 DATE TIME AND VENUE OF THE DRAW

The draw will be held on 14th November - 2018 (Wednesday) at Ludhiana. In exceptional circumstance with the prior approval of the Government the said date of draw and venue can be changed. The Director Punjab State Lotteries will decide the time and venue of the draw.

7 COMMISSION /INCENTIVES TO BE PAID IN SALE OF TICKETS

(a) Commission of Rs. 37.00 (Rs. Thirty Seven Only) per ticket will be given to the agent on the ticket sold. Any commission due shall be paid to the distributor(s) or selling agents out of the money so deposited in the Public Ledger Account or in the Consolidated Fund of the State after depositing 100% payment of the sale proceeds through Bank draft. TDS etc. will be deducted at source while making payment of commission etc.

(b) That the agent/distributors shall conduct the business in accordance with the law/ rules and regulations as may be in force in various State/Union Territories of India and shall pay taxes, levies, octroi etc, as may be applicable from time to time. Presently the Central Govt. has introduced GST on lotteries and the same will be paid by the Distributor as per Notifications issued by Govt. of India. Further any other tax on Lotteries imposed by the Central Government/ State Government from time to time will be borne by the distributor/selling agent or as decided by the Government. Any commission due shall be paid to the distributor(s) or selling agent(s) out of the money so deposited in the Public Ledger Account or in the Consolidated Fund of the State after 100% payment of the sale proceeds is deposited by them through Bank draft/Cyber Treasury. TDS etc. will be deducted at source while making payment of commission etc.

(c) There will be a promoter coupon worth Rs. 300/- each in bundle of 20 tickets. The sellers will be given Rs. 300/- on sale of 20 tickets on surrendering / submitting of the Promoter Coupon. However, this amount of Rs. 300/- will not be given / available, if the seller is getting promoter incentive amount on the basis of a prize winning tickets from that bundle. If there are more than one prizes on one PWT than the seller will only be entitled the highest available incentive.

8 PROCEDURE FOR ISSUE OF TICKETS AND DEPOSIT OF SALE PROCEEDS.

i) Any Distributor(s)/Selling Agent(s) for this Lottery scheme will be appointed subject to the condition that they will have to ensure sale of at least 4,50,000 (Four Lakh Fifty Thousand ) tickets in first instance , in case there is a single Distributor/ Agent, if there are two agents the limit of minimum tickets for each Distributor/agent will be 2,25,000( Two lakh twenty five thousand) tickets in first instance and in case there are more than two distributors/agents the minimum limit of lifting the ticket will be 1,50,000 (one lakh fifty thousand) tickets in first instance for each distributor/agent.
This department may also appoint more Distributors/ Agents, who will be required to sell at least two lac tickets in the first instance or as decided by the Director. Agreement will be executed by the department with the Distributor/Selling Agent and the department will obtain an agreement signing fee of Rs 10 lac (Rupees Ten lacs) from the distributor/agent in the shape of D.D. in favour of Director, Punjab State Lotteries payable at Chandigarh, which will be adjusted at the time of lifting of tickets by them and in case the distributor/agent fails to lift tickets, this amount of Rs. 10 lac will be forfeited.
However, considering the market situation and in the best interest of the state and to increase the sale of tickets, the Director Punjab State Lotteries may, if deemed appropriate, may increase or decrease this minimum limit of tickets. In order to promote the sale of tickets and in Public Interest, the Department can work out distribution and sale of tickets directly or through District Small Saving Officer, District Small Saving agents or Post Offices in Punjab or any other Department, Semi Government entity, Corporation or Board etc., by offering different rate of commission /promoter coupons and specifying different minimum limits (if any) for lifting of tickets and other suitable terms, to be decided by the Director Lotteries. The delivery of tickets will be given at Ludhiana. The expenditure on sending tickets by post/courier service if demanded by anyone will have to be borne by the concerned distributor/agent.
In order to make Punjab State Lotteries more popular in other States, the department will explore the possibility of sale of tickets in other States as per the law. Minimum number of tickets to be sold in other States will be decided by Director Punjab State Lotteries and further the Director Lotteries, at his own level will do the appointment of Distributor/Agent for sale the tickets in other States.

ii) The Distributor/Selling Agents shall get delivery of tickets by making payment of 100% of the face value in cash/Bank Drafts;

Or

The distributor/selling agents shall get delivery of tickets on following payment terms: -

a. Payment of at least 25% of the face value as Cash /Bank Drafts; and

b. 75% by furnishing security in the shape of Bank Guarantee / FDR etc. mortgaged/ pledged in favor of the Director, Punjab State Lotteries, Chandigarh. Validity of the bank Guarantee / FDRs should remain valid for sufficient period. However the balance payment of 75% of face value of tickets sold subject to minimum specified limit as on the date of draw, if any, has to be paid on or before the date of draw, itself through Demand Draft failing which the agent shall be charged interest @18% p.a, for the delayed period. Interest will be charged on month to month basis.

(iii) The tickets will not be issued to the Distributor/Selling Agents if they fail to settle the accounts of any previous lottery scheme within stipulated period.

(iv) The request for sending the ticket by post as received in office will not be entertained and the tickets will not be dispatched to the individual customer from office.

(v) The tickets shall be issued to the selling agents/distributor as per the procedure laid down in condition 8(ii) above. However full and final payment as per the face value of the tickets so sold shall be paid as prescribed above through Demand Draft, failing which the distributor/agent shall be charged interest @18% p.a, for the delayed period. Interest will be charged on month to month basis.

9 UNSOLD TICKETS

The distributor/selling agent will submit the list of unsold tickets, in shape of hard copy and soft copy, subject to the minimum tickets prescribed [in para 8(i)] here to be lifted in the first instance, in the office of Director Punjab State Lotteries up to 12.00 noon on the date of draw and no list of unsold tickets would be entertained by the office after scheduled time. The signed list of unsold tickets can be sent through registered post or through special messenger or email but this Department will not be responsible for any postal delay.

10 PAYMENT OF PRIZES/ INCENTIVES TO PRIZE WINNERS/DISTRIBUTOR/AGENTS

(i) All the prize winning tickets above Rs. 5,000/- should reach the office of the Director, Punjab State Lotteries, Vit Te Yojna Bhawan , Plot No. 2-B , Sector 33 A, Chandigarh-160020 on the prescribed form within 30 days from the date of publication of the result in the Punjab State Government gazette either personally or through a nationalized bank or by registered post or by insured parcel.

(ii.) Sellers’ and Sub- Agents’ promoter incentive up to Rs. 1,000/- should be claimed from the Distributor(s)/Selling Agent(s) within 30 days from the date of publication of the result in the Punjab State Government Gazette and the promoters prizes above Rs. 1,000/- should be claimed directly from the Director, Punjab State Lotteries Vit Te Yojna Bhawan, Plot No. 2-B , Sector 33 A, Chandigarh-160020 within 30 days from the date of publication of the result in the Punjab State Government gazette. The Distributor/ Agent(s) promoter incentive may be claimed from the Director Punjab State Lotteries directly. TDS will be deducted at source while making payment of such incentive(s).

(iii) In case the prizewinners claim does not reach this Directorate within 30 days, the right of the winner to claim the prize/amount thereafter shall be extinguished in accordance with the Punjab State Lotteries Rules 2015. The Director or the State Government, as the case may be, may in exceptional circumstances and on sufficient cause being shown, condone the delay in submission of claim after the prescribed 30 days in accordance with the rules ibid. Distributor/Agents are authorized to make the payment of prizes/incentives below above said limit and seek reimbursement from office within 90 days from the date of publication of the result in the Punjab State Government gazette.

(iv) A ticket which is forged, torn out, mutilated or tampered with, shall not be entertained.

11 Permission to sell Punjab Lottery through computer terminals/Internet as Additional Marketing Strategy

The Government at its sole discretion may allow the Distributor/Selling Agent to sell part or all lottery tickets through web site/ internet mode as as additional market strategy. The permission in this regard will be allowed on the following conditions:-

1) Sale of tickets through Internet will be governed strictly for the particular lottery. The tickets should be sold only on the particular computer terminals only installed at the sale points mention by Distributors.

2) The RPOS selling tickets of lottery schemes of Punjab Government should be within boundaries of Punjab State. No computer terminal will be installed outside the State of Punjab.

3) The tickets for a particular lottery scheme (s) sold through both conventional retail outlets and Internet outlets will not exceed the total number of tickets of that particular lottery scheme(s).

4) The total number of lottery tickets with numbers fed in the Server Machine for selling through Internet and number of sold and number of tickets in hand with respective tickets numbers shall be notified through Internet before commencement of draw of a particular scheme and a written statement thereof shall also be submitted to this Department.

5) The programming shall be so configured to ensure that as soon as a particular ticket number is sold, the number of the ticket shall be eliminated from the list of the tickets available for sale.

6) The Internet system being used will be subjected to a system audit at the distributor level by any audit agency. The IT system audit report be from the CERT-IN approved agency. The Distributor/Selling Agent will have to bear the expenditure on the system audit.

7) The Central Computer Server which accepts, processes, stores and validate each transaction must be under the control of the Director, Punjab State Lotteries.

8) The mirroring server(s) should be placed at the office of Directorate of Lotteries for complete transparency and accountability.

9) The Management Information System shall provide detailed information regarding the complete scheme and each and every transaction on the following to the Director, Punjab State Lotteries from time to time through Dealer Control Panel/Replica of system.

a.1. Passwords Master Passwords / Sub Password, a.2. Agent Identity Code No. a.3. Sub Agent Registration. a.4. Sub Agent List. a.5. Sub Agent wise daily sales. a.6. Scheme/Stock availability.

The Distributor/Selling Agent will ensure that the application software interface have some minimum common features and functionalities to ensure a high level of reliability, security, redundancy, scalability and manageability. The Distributor will provide the entire feature related with the sale, encashment etc. of tickets as in the master server.

10) Complete specification of the hardware, software, networking and data center infrastructure must be provided by the network provider.

11) The distributor/agent shall furnish the income tax clearance certificate or Return acknowledgement for the last 5 years from the Income Tax Department, Government of India.

12) The service provider for the network to sell the lottery on computers must be an ISO 27001: 2013/9001:2015 certified company.

13) The Central Computer System installed by the Distributor/Selling Agent will be under the control of the Government i.e office of Director, Punjab State Lotteries. The operation be done under the strict control and supervision of the Directorate of Punjab State Lotteries, The Central Computer System shall be equipped with all the desired information by maintaining redundancy at the office of Director.

14) The application of distributor/agent for permission to sell the lottery through computer terminals will be analyzed by the office of Punjab State Lotteries with the IT team and thereafter a letter of approval will be issued to the concerned distributor/agent.

15) The Distributor/Selling Agent will have to use pre printed and pre numbered stationary for printing of cash receipts at the retail outlets. The same will be provided by the Government however the cost of this will be recovered from the concerned agent.

16) No information regarding Punjab Lotteries other than the lottery results duly signed by the officer(s) of the Lottery Department and advertisements duly approved by the Director, Punjab State lotteries shall be fed/ passed through INTERNET channel.

17) No separate draws shall be conducted for those lotteries sold partly or fully through INTERNET.

18) All expenditure on creation of Central Computer System Infrastructure, assets, expenditure on men power, management, connection charges, other charges etc. shall be borne by Distributor.

19) The Distributor will ensure the compliance of all rules, laws, regulations and orders etc. and in the event of any violation of any, the responsibility will rest on the Distributor and Distributor/Selling Agent will be liable to compensate the Government in case of any loss / damages suffered by the Government.

20) The permission to sell lottery tickets is subject to the territorial jurisdiction of Punjab except the permission granted for lottery operating State by the Government. The Distributor has to submit an undertaking that they are not marketing any ticket through Internet outside the territorial jurisdiction of Punjab and the territorial jurisdiction of Punjab will not be violated in any event.

21) In case there is violation of any of the terms and conditions mentioned above, the permission so granted shall be taken back by the Government without any notice or compensation of any kind.

22) In case of any loss to the Government due to sale of tickets though Internet the permission shall be withdrawn.

23) The permission being given is provisional and can be withdrawn at any time by the Government without assigning any reason and the Distributor/Selling Agent will not be entitled to any damages/ loss on creation of infrastructure etc. The use of such discretion by the Government shall be binding on the Distributor/Selling Agent.

24) The Distributor/Selling Agent shall ensure that receipts/ cash memo as proof of purchase of tickets being generated at the terminals bear the logo of the Punjab Government.

25) As per the scheme sanctioned for each draw, the number of tickets to be sold through Internet for each draw shall be intimated to the Director at least one week in advance.

26) In the event of any loss accruing to the Government due to the actions on the part of the Distributor/Selling Agent or dispute between the Distributor and its sub-Agents /Retailers or any other person in regard to the sale of tickets or any other reason, the Governments shall be at liberty to withdraw this permission, the decision of the Government in this regard will be final and binding on the Distributor/Selling Agent.

27) In case there is violation of any of the terms and condition mentioned above, the Government will have the absolute right to withdraw this permission and the Distributor/Selling Agent shall not be entitled for any compensation of any kind.

28) The tickets which have been put on the computer terminal shall not be sold manually. In case any ticket number is sold twice or more due to any error/mistake, the distributor/agent would have to pay the extra amount of prize money of the extra tickets.

29) The compliance of above mentioned conditions is a pre condition for the sale of tickets of Punjab State Lotteries on terminals through Internet/Website.

12 LEGAL JURISDICTION:

The legal jurisdiction of this lottery shall be only at Chandigarh.

13 OTHER IMPORTANT CONDITIONS OF THE SCHEME

i.) The draw for the prizes will be held out of the total scheme. However, the draw of first prize(s) and second prize(s) will be out of sold tickets only.

ii.) Income Tax on prizes / incentive(s) to sellers etc., wherever applicable, shall be deducted at source irrespective of the fact whether the prize goes to the winners, distributor(s)/selling agent(s) or seller(s).

iii) Promotional publicity will be got done through the Directorate Public Relation Department Punjab , Chandigarh on the DAVP/DPR rates through the mode of T.V., Radio, newspapers, banners, hoardings etc. Therefore, a provision of Rs 50.00 lacs (Rupees Fifty lacs only) is made for advertising through T.V, Radio, Newspapers and hoardings etc. and Rs. 10.00 lacs (Rupees Ten lacs only) for printing of tickets, coupons etc. Distributors/Agents may be allowed to make publicity through banners and cassettes, the rates/criteria of which will be approved by the Designated Authority.

iv) GST imposed by the Government of India on Lotteries will be borne by the Distributor/ Selling Agent.

v) Distributor(s)/Selling Agent(s)/ Sub Agents and sellers are advised to check the correctness of the printing and numbering of the tickets before selling and buyers should also check the same before purchasing tickets. Defective tickets should not be sold to the public, but should immediately be returned to the issuing authority

vi). A ticket, which is forged, torn out, mutilated or tampered with shall not be entertained.

vii). Prize will be paid on the production of original tickets only.

viii) Prize winning tickets holders abroad will be paid in Indian currency as per scheme.

ix) One ticket/coupon will be eligible to only one incentive viz. The highest incentive drawn against it.

x). In case of any dispute, the decision of the Principal Secretary to the Government of Punjab, department of Finance shall be final and binding.

xi) Before submitting the claim, results may be Checked with the Punjab State Government Gazette.

xii) The request for sending the tickets by post as received in the office will not be entertained and the tickets will not be dispatched to the individual customers from office.

xiii) The provisions of ‘The Lotteries (Regulation) Act 1998‘ and ‘The Lotteries (Regulations) Rules, 2010 and Punjab State Lotteries Rules 2015 shall be applicable.

14 AMENDMENTS TO THE SCHEME

The Government of Punjab may at any time amended/ delete/ modify/ relax any of the provisions of the Scheme under the orders of the Principal Secretary Finance; Government of Punjab in exceptional circumstances without assigning any reasons(s).

2 METHOD OF DRAW

Department of Post Office will pay taxes, levies, etc, as may be applicable from time to time. Presently the Central Govt. has introduced GST on lotteries and the same will be paid by the Department of Post Office as per Notifications issued by Govt. of India. Further any other tax on Lotteries imposed by the Central Government/ State Government from time to time will be borne by the Department of Post Office or as decided by the Government.

(b) There will be no promoter coupon with the tickets issued to Department of Post.

5 PROCEDURE FOR ISSUE OF TICKETS AND RETURN OF UNSOLD TICKETS

i) The Directorate of Punjab State Lotteries will deliver the tickets at its own cost at the Head Post Offices within the State of Punjab. However the delivery of tickets to Post/Sub Post / Branch Offices under the Head Offices shall be managed by the Department of Posts at their own cost.

ii) Office of Chief Post Master General will work as a wing of Government and being as a Central Government Organization, the Office of Chief Post Master General will deposit the value of sold tickets @ Rs. 138.57 per ticket to the Directorate of Lotteries Punjab on or before the date of draw in shape of Demand Draft/Cyber Treasury.

(iii) Directorate of Lotteries Punjab will provide publicity material such as posters and/or banners etc. to the post offices for the publicity of sale of tickets of scheme through Post offices at their own cost and distribute this material in post offices of Punjab. Promotional publicity will be got done through the Directorate Public Relation Department Punjab , Chandigarh on the DAVP/DPR rates through the mode of T.V., Radio, newspapers, banners, hoardings etc. Therefore, an additional provision of Rs 10.00 lacs (Rupees Ten lakhs only) is made for publicity for sale of tickets through post offices.

(iv) The Department of Post will return the unsold tickets within one month from the date of draw.

(v) No advance / security will be paid by the Department of Post in lieu of tickets issued being a Central Government Organization.

6 UNSOLD TICKETS

The Department of Post will submit the list of unsold tickets, in the office of Director, Lotteries up-to 5.00 PM one day before the date of draw and no list of unsold tickets would be entertained by the office after scheduled time. The signed consolidated list of unsold tickets from all the post offices of Punjab will be obtained from Chief Post Master General Office both in hard copy and soft copy or through email.

7 OTHER IMPORTANT CONDITIONS OF THE SCHEME

i.) The draw for the prizes will be held out of the total scheme. However, the draw of first prize(s), second prize(s) and third prize(s) will be out of sold tickets only.

ii.) The department of Post shall make the payment of prizes up to Rs. 5,000/- on behalf of the State Government within 30 days from the date of publication of the result in the Punjab Government Gazette and seek reimbursement, if any, within a period of ninety days from the date of draw, provided this time can be extended by the Director, Punjab State Lotteries with the prior approval of the State Government. All the prize winning tickets above Rs. 5,000/- should reach the office of the Director, Punjab State Lotteries, Vit Te Yojna Bhawan , Plot No. 2-B , Sector 33 A, Chandigarh 160020 on the prescribed form within 30 days from the date of publication of the result in the Punjab State Government gazette either personally or through a nationalized bank or by registered post or by insured parcel. In case the prizewinners claim does not reach this Directorate Punjab State Lotteries within 30 days, the right of the winner to claim the prize/amount thereafter shall be extinguished.

iii). Income Tax on prizes / incentive(s) to sellers etc., wherever applicable, shall be deducted at source irrespective of the fact whether the prize goes to the winners, distributor(s)/selling agent(s) or seller(s).

iv). A ticket, which is forged, torn out, mutilated or tampered with shall not be entertained.

v). Prize winning tickets holders abroad will be paid in Indian currency.

vi). The legal jurisdiction of this lottery shall be only at Chandigarh.

vii). One ticket/coupon will be eligible to only one incentive viz. The highest incentive/prize drawn against it. In that case the number of prizes will reduce accordingly.

viii) In case of any dispute, the decision of the Principal Secretary to the Government of Punjab, Department of Finance shall be final and binding.

ix). Results may be Check with the Punjab State Government Gazette.

x) For more details, please see the Lotteries (Regulation) Rules, 2010 of the Government of India.

xi) Any of conditions of this scheme may be amended/ deleted/ modified/ relaxed at any time by the Principal Secretary to the Government of Punjab, Department of Finance in exceptional circumstances without assigning any reasons(s).

Notes:

i) Printing of tickets / promoter coupons will be got done from the Security Printing Press on the panel of Reserve Bank of India or the Indian bank Associations Mumbai, However, lottery posters/banners will be got printed from the private printing press which stands selected through open tenders at approved rates or as decided by the Govt. keeping in view the prevailing circumstances.

ii) The expenditure for making payment to Prize winners/Selling Agents/Distributors / Sellers/ Advertisers/ GSM checking Institutions/ Laboratories/ Printers, Taxes/Charges (if any), Draw Exp. etc. under this scheme shall be met from the Budget grant provided in the budget by the State Government. The Director, Punjab State Lotteries is authorized to sanction make all kinds of payments mentioned above. Incentive to officers / officials will be paid as per policy decision to be taken in this regard on a separate file.
